Terms and Conditions
Introduction
These terms and conditions (“Terms”) outline the rules and regulations for the provision of arborist services by Branch Management Tree Services (“we”, “our”, “us”)..
1. Scheduling and Arrival
1.1. Branch Management will confirm the estimated time of arrival (ETA) one business day before the scheduled tree work.
1.2. The ETA is subject to change and is only provided as an estimate.
2. Payment Terms
2.1. Payment is due upon completion of services unless otherwise agreed in writing. We accept payment by cash, check, or electronic transfer.
2.2. A 5% late fee will be added to the invoice if payment is not made by the due date for residential clients. A late fee of 5% will also apply if payment is not made within 30 days for commercial clients unless otherwise agreed.
2.4. For residential clients who fail to pay within the 7-day period, a 5% late fee will be added weekly until full payment is received.
3. Client Responsibilities
3.1. Clients must provide accurate information regarding property boundaries, underground utilities, and any other relevant details affecting the services.
3.2. Clients are responsible for obtaining necessary permits or permissions required for tree removal or other services, where applicable.
3.3. The client is responsible for preparing the work area to safeguard personal belongings prior to Branch Management’s arrival. This includes, but is not limited to: clearing animal droppings, removing items such as pots and hardscapes from beneath the tree that could be damaged, cleaning access paths, and applying tarps to protect house paint.
3.4. Branch Management is not liable for any damages arising from failure to prepare the work area as outlined above.
4. Quotations and Pricing
4.1. Quotations provided are estimates based on the information provided by the client. Final costs may vary depending on on-site conditions.
4.2. Prices are subject to change and will be confirmed with the client before the commencement of work.
5. Changes to the Quotation
5.1. Any changes to the agreed quotation must be communicated to Branch Management at least 24 hours before the crew’s arrival, including but not limited to changes to the access, structures around the tree, and changes in scope.
5.2. Branch Management reserves the right to charge full price for reduced services if adequate notice for changes to the quotation is not provided, or apply additional costs to cover the additional time on site.
6. Permissions
6.1. Written permission from relevant parties, such as neighbours or the council, must be provided when indicated in the quotation.
6.2. If fence panels need to be removed for access, Branch Management will not guarantee reinstallation in the same condition due to potential damage caused by tree movement.
6.3. All work complies with local council regulations and Australian standards. Pruning will not exceed 10% of live foliage unless prior council approval is obtained. Branch Management will not adjust invoices based on a client’s opinion of insufficient pruning.
7. Stump Grinding
7.1. Before stump grinding, all small rocks in garden beds must be removed to prevent potential damage to the house and windows from launched debris.
7.2. Stump grinding will be performed to the depth permitted by the machine and/or the advice of Dial Before You Dig.
7.3. Some roots may remain, and roots will not be chased unless explicitly included in the quotation. Branch Management cannot guarantee the prevention of regrowth.
8. Wood and Foliage Removal
8.1. The phrase “Remove all wood and foliage” in the quotation should be interpreted as a reasonable effort. Some foliage, leaves, twigs, and small branches may remain on-site after tidying.
8.2. Branch Management will not remove Preexisting timber and foliage unless specifically included in the quotation.
9. Equipment Usage and Site Conditions
9.1. Plant machinery, including but not limited to trucks, chippers, excavators, and EWPs, may leave track marks on turf or cause damage to turf.
9.2. Branch Management will not be responsible for rectifying such damage unless explicitly specified in the quotation.
10. Cancellations and Rescheduling
10.1. Clients must provide at least 3 business days’ notice for cancellation or rescheduling of services.
10.2. Cancellation fees may apply for cancellations made less than 1 day before the scheduled service date.
11. Liability and Insurance
11.1. We maintain appropriate insurance coverage including liability insurance and workers’ compensation insurance.
11.2. We are not liable for damages caused by unforeseen circumstances such as acts of nature, pre-existing conditions of trees, or hidden underground utilities.
12. Safety
12.1. Safety is our priority. Clients must keep children and pets away from work areas during service.
12.2. Clients must follow any safety instructions provided by our crew during the service.
13. Complaints
13.1. Any complaints regarding our services must be reported to us promptly. We will investigate and seek to resolve any issues promptly.
14. Warranty
14.1. Branch Management cannot provide any warranty for the regrowth of plants/trees after they have been poisoned or stump ground.
14.2. Services for removing regrowth will require a new quotation.
15. Amendments & Severability
15.1 We reserve the right to amend these Terms at any time. Amendments will be effective upon posting on our website or providing notice to clients.
15.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
